The Kansas Legislature recently passed House Bill 2756 that will reimburse the Owner/Operator of an AST site up to $25,000 for upgrading, permanent tank closures and the development of an SPCC plan, effective July 1, 2006.

You can even remove the possibility of un-reimbursed expenses by having your plans pre-approved. You must meet the following criteria:
- Upgrade and/or closure expenses must be incurred after August 1, 2001 and not later than October 30, 2007. It is imperative to act quickly so that your expenses can be incurred during the relatively short reimbursement window. (It is noted that our previous clients that have contracted us for SPCC plans and the associated costs for any past resulting or future upgrades and tank closures in Kansas that have retail petroleum sales would be eligible for reimbursement within this window of opportunity!)
- The AST facility must have registered with the department on or after November 22, 1993.
- The AST must contain a petroleum product.
- The AST facility must not be located at a pipeline terminal or located on a federal facility, with a storage capacity of 1320 gallons or more, but less than 1,000,000 gallons, used to dispense petroleum to tanker trucks for transportation and sale at another location. ( in other words, the facility must have retail sales of a petroleum product).
- Upgrades must be those required for compliance with 40 CFR 112.
- Application for reimbursement must be made by January 1, 2009.
- The rates and expenses for reimbursement must be reasonable and necessary. Proof of payment for all expenses for which reimbursement is requested must be provided.
The types of services covered under the program are as follows:
The AST upgrade services that are eligible shall include but not be limited to the installation or upgrading of the following:
- secondary containment
- integrity testing
- corrosion protection
- loss prevention
- security
- engineering costs (including SPCC plan preparation)
- drainage
- removal of non-compliant tanks
The permanent tank closures services that are eligible shall include but not be limited to the following:
- removal of tank and piping systems
- removal of tank support and confinement systems
- removal of security systems
- tank cleaning
- disposal of waste petroleum and other waste materials including concrete
